User-Generated Content

By posting, uploading, or sharing content on our Platform, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display your content for the purpose of operating and improving our services.

You represent that you own or have the necessary rights to share any content you post and that such content does not violate any third-party rights.

Prohibited Actions

You are strictly prohibited from engaging in any of the following activities:

• Using the Platform for illegal or fraudulent purposes
• Posting false, misleading, or defamatory content
• Infringing on intellectual property rights of others
• Distributing malware, viruses, or harmful code
• Spamming, phishing, or sending unsolicited communications

Disclaimers & Limitation of Liability

Limitation of Liability

To the maximum extent permitted by Tunisian law, El Mall shall not be liable for any:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from your use or inability to use our Platform
• Actions of third parties or other users
• Technical issues, interruptions, or system failures

Our total liability shall not exceed the amount you paid for our services in the twelve (12) months preceding the claim, if any.

Termination of Use

We reserve the right to suspend or terminate your access to our Platform at any time, with or without cause, including but not limited to:

• Violation of these Terms or our Privacy Policy
• Engaging in prohibited activities
• Providing false or misleading information
• Non-payment for services or products
• Legal or regulatory requirements

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Tunisia, without regard to its conflict of law principles.

Dispute Resolution

• First, through good faith negotiations between the parties
• If unresolved, through mediation under Tunisian law
• Finally, through the competent courts in Tunis, Tunisia

This dispute resolution process shall be the exclusive remedy for any conflicts arising from your use of our Platform.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be communicated through one or more of the following methods:
